Use of Bruce Pody Interiors Website
The Conditions of Business govern the terms of selling the property offered for sale on the Bruce Pody Interiors (brucepodyinteriors.com) website. They create a binding contract between the buyer and brucepodyinteriors.com. The buyer attests to being an interior designer, private collector, dealer or reseller, and agrees to be bound by the Conditions of Business.

Use of BPR
Bruce Pody Interiors sells exclusively to professional buyers and resellers. As professionals they are aware that unless an item is listed as new, or in pristine condition, it may be in need of a touch-up or repair. brucepodyinteriors.com does its best to note the condition of each item, as well as provide a professional image of each item for sale.

Review
If a buyer is basing his purchase on a stated provenance, designer or creator and would like an expert review, the buyer must note this in his offer. If brucepodyinteriors.com agrees to the hold for an expert review, no sale shall be confirmed until the buyer has approved or waived the review. HOWEVER, the hold on the item would only remain in effect for 10 working days from date of request.

Right of refusal
brucepodyinteriors.com can withdraw an item for sale at any time and may refuse service to anyone at anytime at its sole discretion and may not be held liable to the buyer or any third-party for doing so.

AS-IS
All items on the site are sold as-is without warranty, guarantee or representation.

Sale
Once placed, an offer (either verbal or written) cannot be revoked by the buyer.

Deposit
If the cost of an item is over $2000, a 30% deposit, either by credit card or wire transfer, is allowed with the balance due within seven business days.

Purchase and Payment
The buyer authorizes brucepodyinteriors.com to charge the full purchase price on the buyer’s credit card unless a deposit has previously been made. Then the buyer authorizes brucepodyinteriors.com to charge the outstanding balance on the buyer’s credit card. The buyer authorizes brucepodyinteriors.com to cancel the sale if the balance is not collectable and keep the deposit. If the buyer cancels a payment made by credit card, or other means, without first receiving approval from brucepodyinteriors.com, the buyer s is liable for all costs incurred for collecting the amount due, including fees.

Completion
Once the item is delivered to the buyer, brucepodyinteriors.com no longer has any responsibility for the item. If the buyer chooses to arrange their own shipping, brucepodyinteriors.com is no longer responsible for the item once it leaves its possession.

Shipping
brucepodyinteriors.com may offer to assist with shipping. The recommendation of a shipper is provided as a convenience for the buyer. The buyer can arrange his own shipping.

Tax
The buyer is responsible for paying all sales and use taxes, export and important taxes and duties. The buyer shall pay brucepodyinteriors.com the taxes brucepodyinteriors.com is required to collect. However, any failure of brucepodyinteriors.com to collect the taxes will not relieve the buyer’s obligation.

Export
The buyer should make sure that they have the right to import or export the item they wish to purchase.

Governing laws
The sale agreement between the buyer and brucepodyinteriors.com in the Conditions of Business are governed by the State of California. Any dispute arising is the exclusive jurisdiction of the California courts.

Miscellaneous
If anything in the Conditions of Business is deemed void, only that portion is severable, and the rest of the contract will remain in effect and enforceable.

Fraud
The buyer may not make an offer with a false name, invalid or unauthorized credit card. That is fraud and is in violation of both state and federal law.
